Gladwin Joseph, a goldminer of Port Kaituma, Region One, was yesterday freed of a causing death by dangerous driving charge for which bail was set at $1M last year. The charge was dropped after Magistrate Rabindranauth Singh of Port Kaituma Magistrate’s Court upheld a no case submission made by Joseph’s lawyer, Bernard DaSilva. The case was thus dismissed.
Joseph, known as ‘Menty’ was placed on bail last year for allegedly causing the death of 29-year-old Andrew Adams called ‘Greg’, by dangerous driving.
Adams was reportedly killed on January 24, 2024, on the Citrus Grove Main Access Road, Port Kaituma, Region One. The allegation was that Joseph knocked the man and drove away.
Reports are that Adams was found with multiple injuries about his body and was rushed to the Port Kaituma Regional Hospital. However, he died while receiving treatment.
In his submission to the court, DaSilva said that the prosecution failed to prove that, Adams died by motor vehicle accident and that it was Joseph who committed the crime.
Further, he said the prosecution failed to factually prove that: the deceased died as a result of an accident; and that it was the defendant who was the driver, at the time, of the vehicle that caused the accident.
Even further, DaSilva submitted that the prosecution “also abysmally failed to prove the elements of the charge, as set out in section 35 (1) of 51:02, to wit; causing death by dangerous driving.”
He surmised that the evidence adduced by the prosecution “when taken at its highest, is manifestly unreliable.”
