Court of Appeal Judge, Rishi Persaud, has denied the State’s request for an interim stay which would allow it to preserve the powers of Cabinet.

The State is being represented in the matter by Attorney General, Basil Williams.

His request for the interim stay comes on the heels of the High Court’s ruling that Cabinet ceased to exist on the night of December 21, 2018 when the No-Confidence Motion was declared carried by the Speaker of the National Assembly, Dr. Barton Scotland.

In filing his appeal, Williams told the Appellate Court that he is dissatisfied with the decision of the High Court. He said that Chief Justice Roxanne George-Wiltshire erred and misdirected herself in law when she ruled that Cabinet should have resigned.

Williams argued that the decision was unreasonable and cannot be supported. On this basis, he called on the Appeal court to grant the interim stay but his request was denied today.
